Die eben abgeschlossenen transpazifischen Freihandelsverhandlungen haben international von einigen Gesundheits-NGOs schlechte Noten erhalten. Weitere Liberalisierungen stehen aber bereits vor der Türe – mit bereits abschätzbaren gesundheitlichen Folgen.

Am 5. Oktober 2015 haben zwölf amerikanische und asiatische Länder mit der Transpazifische Partnerschaft (TPP) das erste grosse Freihandelsabkommen seit zehn Jahren geschlossen. Mit einem ähnlichen Abkommen zwischen den USA und der EU (TTIP), bei welchem sich die Schweiz bei einem Verhandlungsabschluss ebenfalls beteiligen möchte, sowie dem Dienstleistungsabkommen (TISA) stehen weitere Abkommen in entscheidenden Verhandlungsphasen. Ist mit dem TPP der Damm gebrochen worden, um eine neue heisse Phase der Handelsliberalisierung einzuläuten?

All diesen Abkommen ist eigen, dass sie unter Ausschluss der Zivilgesellschaft ausgehandelt werden, dass sie die Interessen der Entwicklungsländer aussen vor lassen und dass sie eine Architektur aufweisen, die eine spätere Re-Regulierung verhindern sollen. Das Tisa-Abkommen soll etwa eine sogenannten „Ratchet-Klausel“ vorsehen, die verhindern soll, dass beispielsweise eine Gemeinde eine vorgenommene Wasserversorgungsprivatisierung wieder rückgängig machen kann, sollte sie beispielsweise zum Gesundheitsschutz die Kontrolle darüber wieder erhalten wollen.

Intelligente Regulierungen

Überhaupt bleiben – so viel wie man bis jetzt weiss –mögliche gesundheitliche Folgen der Abkommen ungeprüft. Dabei könnte man es heute besser wissen: Das Nordamerikanische Freihandelsabkommen (NAFTA) hat unter anderem dazu geführt, dass gesundheitsschädigende Produkte wie verarbeitete Nahrungsmittel, Süssgetränke oder Tabak in Lateinamerika massiv grössere Verbreitung gefunden haben. Die Zunahme von nicht-übertragbaren Krankheiten wie Diabetes, Herz-Kreislauferkrankungen oder Krebs sind dort direkte Folge davon.

Dies sollte uns eigentlich lehren, dass Regulierungen nicht an sich schlecht sind, solange sie evidenzbasiert, demokratisch legitimiert und transparent sind. Freihandelsverträge sollten in diesem Rahmen Regulierungen ermöglichen – und sie sollten vor der Unterzeichnung mit einer Gesundheitsfolgenabschätzung versehen werden.
